Terms and Conditions (T&Cs)

Section 1 Scope
(1) These Terms and Conditions (hereinafter "T&Cs") apply to all contracts between

(hereinafter "Provider") and the customer (hereinafter "Client") concluded via the website mein-kuechenexperte.de.
(2) Any deviating terms of the Client shall not be recognized unless the Provider expressly agrees to them in writing.
(3) A Client is considered a consumer if the purpose of the service cannot predominantly be attributed to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person acting in the exercise of their commercial or self-employed professional activity when concluding the contract.
Section 2 Subject Matter of the Contract
The Provider offers independent kitchen planning and decision advice. A free introductory conversation is solely for getting acquainted and assessing needs. It is not a paid check or individual consultation.
The specific task, scope, result and price are agreed before paid work begins. The offer does not include ongoing supervision of ordering, delivery, installation or acceptance.
Section 3 Contract Formation
The website describes the available services. The individual offer specifies the service, price and process for accepting the offer. Booking the free introduction does not place a paid order.
Section 4 Prices and Payment
The agreed price and payment terms are stated in the individual offer. Prices for consumers include statutory VAT. No additional work is performed without prior agreement on its scope and price.
Section 5 Existing Agreements
Previously concluded contracts remain subject to the services, prices, credits and terms agreed at the time of booking. The current website does not amend those agreements retroactively.
Section 6 Service Delivery and Cooperation Duties
(1) Services are generally provided remotely by video call, e-mail or phone.
(2) The Client shall provide all documents required for service delivery in due time (e.g., floor plans, offers, photos). Delays due to missing cooperation are not the Provider's responsibility.
(3) Appointments are arranged by mutual agreement. Rescheduling is free of charge up to 24 hours before the agreed appointment. In case of later cancellation or no-show, the Provider may charge the appointment as rendered.
(4) The Provider is entitled to involve qualified third parties to perform services.
(5) Additional work is performed only after agreement on scope and price and express approval by the Client.
Section 7 On-site Services, Service Area and Travel Charges
Any on-site work and travel expenses require a separate agreement on scope and price before they are incurred.
Section 8 Withdrawal Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of contract conclusion.

by means of a clear declaration (e.g., a letter sent by post or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. For this reimbursement, we will use the same means of payment you used for the original transaction unless expressly agreed otherwise with you; in any event, you will not be charged any fees as a result of this reimbursement.
If you requested that services begin during the withdrawal period, you shall pay us an amount proportionate to the services already provided up to the time you informed us of the exercise of the right of withdrawal, in comparison with the full scope of services provided for in the contract.
Early Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely if the Provider has fully performed the service and only began performance after the Client gave express consent and at the same time confirmed awareness that they lose the right of withdrawal once the contract is fully performed.

Section 9 Liability and Service Limits
(1) The Provider is liable without limitation for damages resulting from injury to life, body or health and for damages caused intentionally or by gross negligence.
(2) In the event of slight negligence in breach of essential contractual obligations (cardinal obligations), liability is limited to foreseeable, contract-typical damage.
(3) Otherwise, liability for slight negligence is excluded.
(4) The Provider's services do not constitute legal advice, construction management, warranty representation, or trade execution. The Provider assumes no liability for decisions made by the Client based on the consultation or for services provided by third parties (e.g., kitchen studios, tradespeople, architects).
(5) The Provider's recommendations are manufacturer-neutral and commission-free. The Provider receives no commissions, kickbacks or other compensation from third parties.
Section 10 Confidentiality
(1) The Provider treats all documents and information submitted by the Client as confidential.
(2) Data is only passed on to third parties where necessary for service delivery or where the Client has expressly consented.
(3) The confidentiality obligation continues after termination of the contractual relationship.

Information on the processing of personal data can be found in our Privacy policy.
Section 12 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the Client is a merchant, a legal entity under public law, or a special fund under public law, Stuttgart shall be the place of jurisdiction for all disputes arising from this contract.
(3) Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
